婚前财产公正的程序,婚前财产公证有什么好处

一、办理婚前财产公证的流程
 
I. Procedures for Notarization of Premarital Property
 
 
 
(一)当事人要准备好以下几种材料:
 
(1) The parties concerned shall prepare the following materials:
 
 
 
1、个人的身份证明。如身份证、户口薄,已婚的还要带上结婚证。(已婚也可补办)。
 
1. Personal identification. If you are married, you should bring your marriage certificate with you. (Married or supplementary).
 
 
 
2、与约定内容有关的财产所有权证明。如房产证、未拿到产权证的购房合同和付款发票等能证明财产属性的证明等。
 
2. Proof of ownership of property related to the agreed content. For example, property certificate, purchase contract without property certificate and payment invoice can prove the property attribute.
 
 
 
3、双方已经草拟好的协议书。协议书的内容一般包括:当事人的姓名、性别、职业、住址等个人基本情况、财产的名称、数量。
 
3. The agreement has been drafted by both parties. The content of the agreement generally includes the basic personal information such as the name, sex, occupation and address of the parties, the name and quantity of the property.
 
 
 
(二)准备好上述材料后,双方必须亲自到公证处提出公证申请,填写公证的申请表格。委托他人代理或是一个人来办婚前财产公证,是不会被受理的。
 
(2) When the above-mentioned materials are ready, both parties must apply for notarization in person at the notary office and fill in the application form for notarization. It is inadmissible to entrust someone else to act as an agent or a person to notarize premarital property.
 
 
 
(三)公证申请被接待公证员受理后,公证员就财产协议的内容、审查财产的权利证明、查问当事人的订约是否受到欺骗或误导,当事人应如实回答公证员的提问,公证员会履行必要的法律告知义务,告诉当事人签订财产协议后承担的法律义务和法律后果。当事人配合公证员做完公证谈话笔录后,在笔录上签字确认。
 
(3) After the application for notarization has been accepted by the receiving notary, the notary shall faithfully answer the notary's questions concerning the content of the property agreement, the examination of the proof of property rights, and the inquiry of whether the parties'contracts have been deceived or misled. The notary shall fulfill the necessary obligation of legal notification and inform the parties of their legal obligations and consequences after signing the property agreement. After the parties cooperate with the notary to complete the notarial conversation transcript, they sign the transcript for confirmation.
 
 
 
(四)双方当事人当着公证员的面在婚前财产协议书上签名。至此,婚前财产公证的办证程序履行完毕。
 
(4) Both parties sign the pre-marital property agreement in front of notaries. Up to now, the certification procedure for the notarization of premarital property has been completed.
 
 
 
二、办理婚前财产公证要注意什么
 
2. What should we pay attention to in the process of notarization of premarital property
 
 
 
办理婚前财产公证不是法律上规定的必须公证才生效的事项,它遵循的是当事人自愿的原则,其具体程序是:协议双方当事人应共同到有管辖权的公证处申请办理,填写公证申请表,提交申请人的身份证明,财产权利证明,婚前财产协议书(当事人没写协议的公证员可以应当事人的要求代为书写),其它证明材料。公证员在办理婚前财产公证中,除要认真审查当事人的主体资格是否具备,意思是否表示真实、协议的内容是否不违反法律或者社会公共利益外,认为还要注意审查以下几个方面:
 
Notarization of premarital property is not a matter that must be notarized before it takes effect in law. It follows the principle of voluntariness of the parties concerned. Its specific procedures are as follows: the parties to the agreement should apply to the notary office with jurisdiction jointly, fill in the application form for notarization, submit the identity certificate of the applicant, the certificate of property rights, the notary of premarital property agreement (the notary who has not written the agreement by the parties). It may be written at the request of the party concerned and other supporting materials. In the process of property notarization before marriage, notaries should carefully examine whether the subject qualification of the parties is qualified, whether the intention is true or not, and whether the content of the agreement does not violate the law or the public interest. (一)注意审查婚前财产协议中的内容,约定的财产要做到双方当事人无争议。但在财产的权属问题上,并不是都不存在争议。如笔者在办理这类公证中,就遇到有个别当事人,在结婚前就在一起共同生活了好几年,双方经济共同支配、购置财产(如汽车、房产、股票等),但财产权利凭证上却只写了一方当事人的姓名,表面看是一方的婚前财产,而实际上却是双方共有的。
 
(1) Pay attention to reviewing the contents of the pre-marital property agreement, and the agreed property should be achieved without dispute between the parties. However, there are not no disputes about the ownership of property. For example, in the process of this kind of notarization, the author meets with individual parties who have lived together for several years before marriage. Both parties control and purchase property (such as automobile, real estate, stock, etc.) jointly, but only one party's name is written in the certificate of property rights. On the surface, it seems to be one party's pre-marital property, but in fact it is shared by both parties.
 
 
 
还有的个别的当事人,在准备结婚前,共同出资购房,购买家具、电器等物品,但财产权利凭证上只写了一方的姓名,实际上在这样的财产的权属问题上已存在着问题。因此,公证员在办理此类公证时,一定要注意审查双方当事人在约定的财产权属上是否存在纠纷,协议中财产的归属,债权债务处理的内容上是否明确,要做到双方当事人无异议才能办理公证。
 
There are also individual parties who jointly invest in the purchase of houses, furniture, electrical appliances and other items before getting married, but only one party's name is written on the property right certificate. In fact, there are problems in the ownership of such property. Therefore, when dealing with such notarization, notaries must pay attention to examining whether the parties have disputes over the agreed property rights, the ownership of property in the agreement, and whether the content of the treatment of creditor's rights and debts is clear. Only when the parties have no objection, can they handle the notarization.
 
 
 
(二)对没有房屋产权凭证的婚前财产公证,要注意收集当事人购置财产时给付款项的证明材料。在现实生活中,有的当事人已实际占有、使用房屋,但由于多方面的原因,未获得房屋的产权凭证;还有的当事人,购买了房屋,在房屋还未交付、产权凭证未获得前就准备结婚而申请办理婚前财产公证。
 
(2) For notarization of premarital property without a certificate of housing property rights, attention should be paid to collecting the proof materials of payment when the parties purchase property. In real life, some parties have actually occupied and used the house, but for various reasons, they have not obtained the property right certificate of the house; others have purchased the house and are ready to get married before the house has been delivered and the property right certificate has not been obtained, so they apply for the property notarization before marriage.
 
 
 
对这类当事人,公证员要注意了解房屋的来源,房屋的付款情况,房屋的使用、装修等现状,并收集相关的证明材料,同时应向另一方当事人进行应证,只要另一方当事人认可对方婚前财产的情况属实,并对财产权属的约定无异议,笔者认为这类婚前财产协议,可以公证。
 
For such parties, notaries should pay attention to the source of the house, the payment of the house, the use and decoration of the house, and collect relevant proof materials. At the same time, they should testify to the other party. As long as the other party accepts the truth of the other party's premarital property and has no objection to the agreement on the ownership of property, the author believes that such premarital property agreements are acceptable.
